WILL OF HUGH BORDERS

I Hugh Borders, of the County of Cleveland and State of North Carolina, being of sound mind and memory but considering the uncertainty of my earthly existence, do make and declare this my last will and testament in manner and form following; that is to say:

ITEM 1st. I will to my beloved wife Luvicy Borders all my real estate in the County of Cleveland during her natural life.

ITEM 2nd. I will to my beloved wife all my household and kitchen furniture during her natural life and also will to my said wife all the cash that may be on hand at my death for her individual use.

ITEM 3rd. After my death my will is that every species of personal property belonging to my estate (except that given to my wife as embraced in Item 2) shall be sold and the proceeds arising therefrom divided equally amongst my heirs.

ITEM 4th. I will that my said wife shall enjoy the proceeds of my plantation from year to year as she may choose so long as she may live.

ITEM 5th. My will is at the death of my wife all my real and personal property of any kind and description shall be sold and the proceeds arising therefrom divided equally amongst my heirs. The heirs of Eliza Black, deceased, will represent their mother in this distribution.

ITEM 6th. My heirs at this time are equal therefore all of them come into my estate on an equal footing and will share the distribution of my estate ( after being sold, as directed in Item fifth of this will.)

ITEM 7th. I hereby appoint Thomas Black, son of Eliza Black, deceased, guardian for his brothers and sisters. He will not be required to file a bond for the faithful discharge of his trust but distribute the shares to them severally as they are entitled. I make this appointment by reason of the confidence I repose in him.

ITEM 8th. My will is if any of Eliza Black's heirs should marry before they arrive the age of 21, twenty-one years, their guardian may give to him or her an equal share of such of my estate as may be in his hands.

ITEM 9th. I hereby constitute and appoint my son Michael Borders and my son in-law J.H. Austell my executors to execute this my last will to all intents and purposes and meaning of the same & every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments by me heretofore made.

In witness hereof I the said Hugh Borders do hereunto set my hand and seal this the 15th day of March 1879.
